Terms of Service

Last updated: September 8, 2026

These Terms govern services provided by This Is On Purpose LLC, including Mail On Purpose™. By requesting, approving, purchasing, or using our services, you agree to these Terms.

1) Core Newsletter Services

Mail On Purpose™ provides newsletter-related services that may include sending setup, support, drag-and-drop builder access, list management basics, migration, template rebuilding, weekly design, scheduling, publishing, copywriting, and related consulting. Scope depends on the plan, quote, or written agreement.

2) Client Responsibilities

  • You must provide accurate business information, approved content, brand assets, account access, and timely feedback.
  • You are responsible for the legality, truthfulness, permissions, and accuracy of your offers, claims, images, lists, and materials.
  • You must have proper consent or another lawful basis to email, text, mail, or otherwise contact the people on your lists.
  • You must not provide scraped, purchased, harvested, or unauthorized lists unless explicitly approved in writing and legally permissible.

3) Data, Lists, and Access

We may handle subscriber lists, segments, tags, unsubscribes, suppression lists, templates, campaign history, platform exports, API keys, DNS records, and sending credentials to perform the work. You authorize us to access and process this information as needed. Client-owned accounts remain your responsibility, including platform fees, sending reputation, compliance, and consequences of your sending practices.

4) Sending Practices and Deliverability

We do not guarantee inbox placement, open rates, click rates, conversions, revenue, deliverability, or platform approval. We may decline, pause, or require changes to campaigns that could harm deliverability, violate platform rules, create legal risk, or conflict with our standards.

5) Migration

Migration may include list transfer, template rebuilding, account configuration, domain authentication support, and related setup. Migration fees are non-refundable once work begins. If a migration fee is waived for an annual customer or affiliate setup, the waiver may be conditioned on keeping the qualifying annual commitment or recommended setup active.

6) Plans, Pricing, and Payment

Published pricing is “starting at” pricing based on standard scope, standard sending volume, one newsletter per week where applicable, and normal approval workflows. Additional campaigns, custom automations, high-volume sending, complex segmentation, unusual support, urgent work, platform costs, postage, printing, advertising spend, third-party tools, and out-of-scope requests may be quoted separately.

7) Approvals and Workflow

You are responsible for reviewing and approving drafts, designs, lists, schedules, links, offers, disclaimers, and final messages. If you approve or fail to respond by a stated deadline, we may proceed based on the agreed workflow or reschedule work. Rushed changes may not be possible.

8) Third-Party Platforms

We may use or help manage third-party tools such as Mailchimp, Klaviyo, Constant Contact, EmailOctopus, Acelle Mail, Amazon SES, hosting providers, payment processors, CRMs, and analytics tools. We are not responsible for third-party outages, pricing changes, account closures, deliverability decisions, policy enforcement, data loss, or security incidents outside our reasonable control.

9) Content Standards

All work is subject to our Content Standards. We may decline, modify, pause, or cancel work involving unlawful, deceptive, abusive, high-risk, infringing, or otherwise unacceptable content or sending practices.

10) Intellectual Property

Upon full payment, you receive rights to final approved deliverables created specifically for you, except for our pre-existing tools, systems, templates, processes, know-how, licensed assets, and third-party materials. We retain ownership of our methods, workflows, reusable templates, and internal systems.

11) Confidentiality and Security

We will use reasonable care with confidential information and subscriber data. You agree to provide access only through reasonable, secure methods when possible and to remove our access when no longer needed. No system is perfectly secure.

12) Cancellations and Refunds

Recurring services may be cancelled according to the applicable plan, proposal, or agreement. Work already performed, setup fees, migration fees, third-party costs, annual commitments, and approved production work are generally non-refundable unless otherwise stated in writing.

13) Disclaimers and Limitation of Liability

Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties and are not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages. Our total liability for a claim is limited to amounts paid to us for the specific service giving rise to the claim during the three months before the event, unless a different limit is required by law.

14) Indemnification

You agree to defend, indemnify, and hold harmless This Is On Purpose LLC from claims arising out of your content, lists, instructions, products, services, offers, legal compliance, sending practices, or use of our work.

15) Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Venue is in the state or federal courts located in New Jersey unless otherwise required by law.

16) Changes

We may update these Terms from time to time. Continued use of our services after updates means you accept the updated Terms.
